Second 2 None Automotive's Terms and Conditions of vehicle sales – Used Vehicle Dealership (UK)

These Terms and Conditions apply to all vehicle sales made by [SECOND 2 NONE AUTOMOTIVE] Ltd (“we”, “us”, “our”)
By purchasing a vehicle from us, you (“the Customer”, “you”) agree to these Terms.

1. Definitions
Vehicle – the motor vehicle being purchased.
Order – the agreement to purchase a Vehicle.
Purchase Price – the total price payable including VAT where applicable.
Deposit – any part payment made to reserve a Vehicle.
2. Vehicle Descriptions
2.1 All Vehicles are sold subject to availability.
2.2 Descriptions, mileage, service history, and specifications are given in good faith but may be approximate along with vehicle specifications/options
2.3 You are responsible for checking that the Vehicle meets your requirements before purchase.
3. Prices and Payment
3.1 All prices are in Pounds Sterling (£).
3.2 The Purchase Price must be paid in full before the Vehicle is released, unless otherwise agreed in writing.
3.3 Accepted payment methods include [bank transfer, debit card, finance & crypto.
3.4 Any Deposit paid is subject to clause 7.
3.5 ALL vehicles purchased that have any issues occurring within the 6 month term period we require the vehicles to be returned to us for diagnostics & any repairs to be carried out, using (Autoguard Warranties) issued upon sale. Most of all this is so we can rectify the issue & know it gets done efficiently & most of all correct.
3.6 Any issues with vehicles & customers are based further afield 40+ miles can use any VAT REGISTERED GARAGE to help with any mechanical issues that May arise.
4. Consumer Rights
4.1 Nothing in these Terms affects your statutory rights under UK law, including the Consumer Rights Act 2015.
4.2 Vehicles must be of satisfactory quality, fit for purpose & as described.
4.3 If a Vehicle is faulty, your rights may include repair, replacement, or refund depending on the circumstances.
5. Inspection and Test Drives
5.1 Test drives are available by appointment for genuine, serious buyers only. For insurance & time reasons, we’re unable to accommodate casual or non-serious enquiries. Thank you for your understanding.
5.2 Test drives are undertaken with driving licence proof / shown & a copy will be taken for insurance purposes.
6. Warranty
6.1 Any warranty provided will be detailed separately in writing.(AUTOGUARD WARRANTIES - third party) are our partners in providing quality vehicle premium warranties avalible from
3,6,12,15,18,24,26 month terms, different levels of cover & claim limits are available which prices will vary.
6.2 Unless stated, no mechanical or electrical warranty is implied beyond your statutory rights, if you don't require warranty we will require you to sign off a disclaimer, this is to cover both parties involved.
7. Deposits, Reservations & Cancellations
7.1 Deposits reserve a Vehicle for a limited time only.
7.2 Deposits are refundable or non-refundable depending on the circumstances and must be confirmed at the time of payment.(example:
7.3 To reserve a vehicle, we require a non-refundable holding deposit. This confirms your intention to proceed with the purchase and allows us to remove the vehicle from sale. Once a deposit is taken, the vehicle is reserved exclusively for you. During this period, we stop advertising the vehicle & decline other enquiries. In line with UK consumer law, the deposit represents a genuine contribution towards these costs and the loss of opportunity to sell the vehicle to another customer. For this reason, if you choose not to proceed with the purchase for reasons not related to the condition of the vehicle or any failure on our part, the deposit is non-refundable. If the vehicle is found to be not as described, not roadworthy, or the sale cannot proceed due to an issue on our part, the deposit will be refunded in full, in accordance with your statutory rights under the Consumer Rights Act 2015, this policy is in place to ensure fairness to all customers and to allow us to price our vehicles competitively.
8. Distance or Off-Premises Sales
8.1 Where the sale is made without you attending our premises (e.g., online or by phone), you may have cancellation rights under the Consumer Contracts Regulations 2013.
8.2 You normally have 14 days to cancel after delivery, unless an exemption applies.
8.3 You may be responsible for returning the Vehicle and any associated costs unless otherwise stated.
9. Part-Exchange Vehicles
9.1 Any part-exchange value offered is subject to inspection.
9.2 You confirm that:
you own the vehicle,
it is free from finance or encumbrances unless declared,
mileage is accurate to the best of your knowledge.
9.3 We reserve the right to revise the valuation if information proves incorrect.
10. Title and Risk
10.1 Ownership of the Vehicle passes to you only when full payment has cleared.
10.2 Risk passes to you when the Vehicle is collected or delivered.
11. Delivery and Collection
11.1 Delivery dates are estimates only.
11.2 We are not liable for delays outside our reasonable control.
11.3 You must inspect the Vehicle upon delivery and notify us promptly of any issues.
12. Use of the Vehicle Before Registration Transfer
12.1 You are responsible for tax, insurance, and licensing from the point of collection or delivery.
12.2 We will notify DVLA of keeper changes as required.
13. Complaints
13.1 Complaints should be directed to:

13.2 We aim to respond within [e.g., 5 working days].
13.3 If unresolved, you may refer the matter to Alternative Dispute Resolution where applicable

14. Limitation of Liability
14.1 We do not exclude liability for death or personal injury caused by negligence, fraud, or any matter that cannot legally be excluded.
14.2 Subject to this, we are not liable for indirect or consequential losses.
15. Data Protection
15.1 We process personal data in accordance with UK GDPR and our Privacy Policy.
16. Force Majeure
We are not liable for failure to perform due to events beyond our reasonable control.
17. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
